Privacy Policy

Kanemitsu Corporation (hereinafter referred to as the “Company”) will promote the protection of personal information by establishing its privacy policy (hereinafter referred to as the “Policy”) with regard to the handling of personal information of the Users of the Company’s services (hereinafter referred to as “Users”) as follows: building a system for the protection of personal information and ensuring that all its employees are aware of the importance of and are thoroughly committed to the actions for protecting personal information:

 

Article1 (Personal Information)

“Personal information” refers to information as defined in the Act on the Protection of Personal Information (Act No. 57 of 2003; hereinafter referred to as the “Personal Information Protection Act”) relating to a living individual that can be used to identify a specific individual by name, date of birth, or other descriptions contained in the relevant information, or that contains an individual identification code.

 

Article2 (Purpose of Use of Personal Information)

The Company will obtain the personal information of Users and use the obtained information to the extent necessary for the following purposes, and it will obtain consent from Users in advance in an appropriate manner when using personal information beyond the scope of the following purposes:

(1) to provide the services of the Company (the “Service”);

(2) to improve the Service or to develop new services;

(3) to provide information on new features, updates, and campaigns for the Service as well as other services offered by the Company (including sending e-mails, leaflets, and other direct mails);

(4) to provide information as necessary, such as maintenance information and important notices;

(5) to respond to comments, inquiries, etc., from Users concerning the Service (including identification of the relevant User);

(6) to report the use status of the Service to Users; and

(7) to request that Users for cooperate in questionnaires, interviews, etc.; or for participation in various events concerning the Service, or to report the results thereof.

 

Article3 (Use of Cookies, etc.)

1. The Company may obtain Users’ access information to the Service, browsing information, etc., by using technologies of cookies and other information collection modules (hereinafter collectively referred to as “Cookies, etc.”) for access analysis, etc., of the Service. Such information obtained through Cookies, etc. (hereinafter referred to as “Cookie Information”) will not contain information that can identify Users independently.

2. Users may set their use of Cookies, etc. on the Service. If users need to refuse the use of Cookies, etc., they may disable them in their browser settings; however, the User must note that if cookies are disabled, the convenience of the Service may be impaired or the scope of use of the services provided by the Service may be limited.

3. The Company will use Cookie Information for the operation, quality maintenance, and improvement of the Service, as well as the development and improvement of the Company’s products and services, and the distribution of advertisements appropriate to the Users’ use of the Service.

 

Article4 (Management and Protection of Personal Information)

The Company will manage personal information strictly and take measures to prevent and correct any risks, such as unauthorized access, and loss, destruction, falsification, and leakage of personal information, to ensure the security of the User thereof. In addition, the Company will not disclose or provide personal information to any third party without the User’s consent, except in the following cases:

(1) when it is necessary for the protection of the life, body, or property of a person, and it is difficult to obtain the consent of the Users;

(2) when it is particularly necessary to improve public health or to promote the sound growth of children and it is difficult to obtain the consent of the Users;

(3) when it is necessary to cooperate with a national organ, or a local government, or an entrusted person, thereby executing administrative business prescribed by laws and regulations, and the acquisition of the Users’ consent may interfere with the execution of the relevant business; and

(4) when otherwise approved pursuant to laws and regulations.

 

Article5 (Entrustment of the Handling of Personal Information)

The Company may outsource all or part of the handling of personal information within the range necessary to achieve the purpose of use. In such case, the Company will fully examine the eligibility of the contractor, provide rules and other details concerning confidentiality obligations in entering into the contract, and provide necessary and appropriate supervision over the contractor.

 

Article6 (Disclosure of Personal Information)

Users may request that the Company disclose personal information held by the Company in accordance with the procedures set forth in Article 9. Upon receipt of such a request from a User, the Company will disclose the relevant information to the User without delay, provided, however, that the Company may decide not to disclose all or part of the information in any of the following cases, and if deciding not to disclose the same, the Company will notify the relevant User of such a decision without delay:

(1) when such disclosure is likely to damage the life, body, property, or other rights or interests of Users or a third party;

(2) when such a disclosure may significantly interfere with the proper execution of the Company’s business; or

(3) when such disclosure will otherwise violate laws and regulations.

 

Article7 (Correction, etc., of Personal Information)

1. If any personal information held by the Company is incorrect, Users may request that the Company to correct, add to, or delete (hereinafter collectively referred to as “Correct”) such personal information in accordance with the procedures set forth in Article 9.

2. Upon receipt of a request under the preceding paragraph, the Company will conduct a necessary investigation without delay, and if it determines as a result of such investigation that there are grounds for such a request, will Correct the relevant personal information without delay.

3. The Company will notify the relevant User without delay of the decision it has made as to whether or not to Correct the information in accordance with the preceding paragraph.

 

Article8 (Suspension, etc., of the Use of Personal Information)

1. Users may request the Company to suspend the use of, delete, or suspend provision to third parties of, personal information held by the Company (hereinafter collectively referred to as “Suspend the Use, etc.”) in accordance with the procedures set forth in Article 9.

2. Upon receipt of a request under the preceding paragraph, the Company will conduct a necessary investigation without delay, and if it determines as a result of such an investigation that there are grounds for such a request, it will Suspend the Use, etc., of the relevant personal information; provided, however, that, in cases where Suspending the Use, etc., of the personal information will require a large expenditure or it is otherwise difficult to Suspend the Use of the personal information, and it is possible to take alternative measures necessary to protect the User’s rights and interests, the Company will take such alternative measures.

3. The Company will notify the relevant User without delay of the decision it has made as to whether or not to Suspend the Use, etc., of the information in accordance with the preceding paragraph.

 

Article9 (Procedures for Disclosure, etc., of Personal Information)

To make a request as set forth in Articles 6 to 8, Users will be requested to send a request form together with an identification document, as specified in (1), to the address specified in (2) below. For disclosure of personal information, a fee of 800 yen will be required for each request:

(1) Identification document:

(i) For a request by the User themselves:

- a copy of the driver’s license, passport, or health insurance card of the User, or any other document that can be used to identify the User (any one of the above); or

(ii) For a request by a representative:

- a copy of the driver’s license, passport, or health insurance card of the User, or any other document that can be used to identify the User (any one of the above);

- a copy of any one of the driver’s license, passport, or health insurance card of the representative, or any other document that can be used to identify the representative; and

- a letter from an attorney indicating that the representative is acting on behalf of the relevant User.

Article10 (Procedure for Change to Privacy Policy)

The Company will review the contents of this Policy from time to time and endeavor to improve it accordingly. The contents of this Policy may be modified, except for matters that are otherwise provided for in laws, regulations, or this Policy. After modification, the Privacy Policy will become effective at the time when it is communicated to Users or posted on the Company’s website in a manner prescribed by the Company.

 

Article11 (Compliance with Laws, Regulations, and Norms)

The Company will comply with Japanese laws and regulations applicable to personal information held by the Company, as well as other norms.

 

Article12 (Response to Complaints and Consultations)

The Company will accept and respond appropriately and promptly to complaints and consultations from Users concerning the handling of personal information, and will also respond promptly and appropriately to requests from Users to disclose, correct, add to, delete, or refuse the use or provision of personal information of the relevant Users.

 

Article13 (Security Control Measures)

The Company will take organizational, physical, personnel, and technical measures such as restricting access to personal information files, recording access logs, and implementing security measures to prevent unauthorized access from outside the Company to prevent unauthorized access to, or loss, destruction, falsification, or leakage of, the personal information entrusted by Users. In the event that an accident such as a leakage of Users’ personal information should occurs, the Company will report it to the regulatory authorities promptly in accordance with the Personal Information Protection Act and related guidelines, and in accordance with the instructions of such regulatory authorities, will take necessary action such as taking measures to prevent the occurrence and recurrence of similar incidents.
